Judge Rules Biden’s Student Loan Forgiveness Plan an Unconstitutional Threat to Democracy

Well, that’s not exactly what the judge said, but it’s pretty darn close in so many words. President Biden’s student loan forgiveness plan has been finding itself in courtrooms around the country being challenged on a litany of legal grounds.

The latest lawsuit, out of Texas, struck down Biden’s student loan forgiveness plan calling it an egregious act of unconstitutional executive overreach and pointed out that the country is governed by the constitution, not by an “all-powerful executive with a pen and phone”:

A federal judge in Texas on Thursday night struck down President Joe Biden’s student loan forgiveness plan, calling it one of the most egregious executive overreaches in presidential history.

U.S. District Judge Mark Pittman made the decision in a case brought by two Americans and supported by the small business group Job Creators Network.

“Whether the Program constitutes good public policy is not the role of this Court to determine. Still, no one can plausibly deny that it is either one of the largest delegations of legislative power to the executive branch, or one of the largest exercises of legislative power without congressional authority in the history of the United States,” Pittman wrote.

Pittman wrote Biden’s plan violated the separation of powers in the Constitution.

“In this country, we are not ruled by an all-powerful executive with a pen and a phone. Instead, we are ruled by a Constitution that provides for three distinct and independent branches of government,” he wrote.

The question goes without saying. If Biden knows this student loan forgiveness plan is an overreach based on shaky legal ground and announced under the auspices of a now-ended Covid emergency, why is he violating the constitution and damaging the office of the Presidency? If there is a threat to democracy happening right now, it’s emanating from the Oval Office on mandate after mandate that gets shot down in court.

Let’s just imagine, for a moment, that a Republican president was attempting something similar by transferring $400 billion taxpayer dollars from one constituency to another in the name of “debt forgiveness” or basically “debt cancellation.” The media and Democrats would shriek over the audacity to simply use federal money in a way that is clearly diametrically opposed to a separation of powers.

If the House or Senate, elected by the democratic process, couldn’t or wouldn’t craft legislation to forgive student loans, then how does Biden have the authority to simply do it on his own with a stroke of his pen? The very notion seems anti-democratic but with the media running cover, it’s painted as a worthwhile plan to help struggling borrowers.

The problem with Biden’s “threat to democracy” argument is that he claims “MAGA Republicans” are wrecking democracy, then he turns around with things like the Covid vaccine mandate and student loan forgiveness plan, executive orders that everyone, including the White House, know are unconstitutional, but they do it anyway for short-term gain.

Biden has no credibility when it comes to defending democracy, rule of law, or the United States Constitution.
