Kamala Harris to the Supreme Court? Don’t Make Me Laugh

Following Kamala Harris’ devasting electoral loss to Donald Trump, some Democrats are pining for a way to deliver her a consolation prize and stick it to MAGA along the way.

One avenue that at least has a potential to explore would be President Biden appointing Harris to the United States Supreme Court before January 20, 2025. Obviously, the time frame would have to be sped up immediately and it would require one of the existing liberal justices to step down which is likely the biggest impediment to such a laughable stunt.

Nonetheless, some Democrats, namely Bakari Sellers speaking to CNN this morning, want to see heads explode on the right as payback for Trump stomping all over the blue wall:

So, how does that work?

There are currently 9 sitting Justices, 6 conservatives and 3 liberals. None of the liberal justices look ready to retire anytime soon meaning the court is currently full. Is he suggesting Democrats pack the court by adding Kamala Harris as a 10th justice? The majority of a 10-justice court would still lean conservative by a 6 to 4 margin rather than the current 6 ot 3 meaning the balance wouldn’t immediately change.

The only real possibility to make an vacancy for Harris would be if Sonia Sotomayor, age 70, decided to up and retire right now paving the way for the unprecedented move.

Part of the push for Harris on the court is the fact that Donald Trump will undoubtedly confirm one or more new Supreme Court Justices during his upcoming term. While it’s unlikely for any of the liberal justices to retire, longtime members like Clarence Thomas, 76, and/or Justice Samuel Alito, 74, maye head for an exit during a friendly administration.

Could a Harris appointment really happen in two months? Sellers seems to think so according to Newsweek:

Speaking to CNN’s John Berman, Sellers suggested that putting Harris on the Supreme Court would give the vice president a new role after she was defeated by Donald Trump in the 2024 presidential election while also guaranteeing a long-term liberal seat.

He suggested it could be rushed through before Trump takes the presidency.

“I think that’s actually a very good plan. I think it’s something that should happen,” he said.

“You know, Justice Sotomayor has been a more than able justice. I know that she may be having some personal issues that she contends with while serving on the bench. But, you know, I don’t want Justice Sotomayor to be another Ruth Bader Ginsburg in terms of staying too long.”

Just to put this up front, the chances of this happening are near zero but maybe not zero. It could happen, but it won’t. Give it a 0.05% chance.

Set aside the fact that Harris has no judicial pedigree to speak of and has never actually served as a judge at any level. Her background as a prosecutor and amateur politician is not a preparatory pathway for a golden ticket to the Supreme Court.

Toss this one in the liberal trash heap of bad ideas that shall never be spoken of again.
